Terms of Service

By accessing or using OpenHouseCanada ("the Service"), operated by OpenHouseCanada Inc., you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may modify these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

You must be at least 18 years of age and a resident of Canada to create an account or use the Service. By using the Service, you represent and warrant that you meet these requirements.

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to:

• Provide accurate and complete registration information
• Keep your account information up to date
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with third parties

We reserve the right to suspend or terminate accounts that violate these Terms.

The Service supports multiple user types with different permissions:

• Buyers/Renters: May search listings, save favourites, schedule tours, and send inquiries.
• Real Estate Agents: May create and manage property listings, respond to inquiries, and manage open house schedules. Agents represent that they hold valid real estate licences in their province of practice.
• Landlords: May manage rental properties, tenants, and documents through the Landlord Portal.

Users who create listings are responsible for the accuracy and legality of their content. You agree that:

• All listing information is accurate, current, and not misleading
• Photos and descriptions represent the actual property
• You have the legal right to list the property
• Listings comply with all applicable Canadian real estate laws and regulations
• Pricing information is accurate and not deceptive

We reserve the right to remove listings that violate these guidelines without prior notice.

You agree not to:

• Use the Service for any unlawful purpose
• Post false, misleading, or fraudulent content
• Impersonate another person or entity
• Scrape, harvest, or collect user data without consent
• Interfere with or disrupt the Service or its servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated tools (bots, spiders) to access the Service without permission
• Send unsolicited communications (spam) through the Service
• Discriminate against any individual in violation of Canadian human rights laws

The Service, including its design, code, text, graphics, logos, and other content, is owned by OpenHouseCanada Inc. and protected by Canadian and international copyright, trademark, and intellectual property laws.

By posting content on the Service (listings, photos, documents), you grant us a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote your content in connection with the Service.

The Landlord Portal allows you to upload, store, and share documents, and to sign documents electronically. You acknowledge that:

• You are responsible for the content and legality of documents you upload
• Electronic signatures created through the Service are intended to be legally binding under the applicable provincial and federal electronic commerce legislation
• We do not provide legal advice regarding document validity
• You should consult legal counsel for important legal documents
• Shared document links may be accessible to anyone with the link

The Service may integrate with or link to third-party services. We are not responsible for the content, privacy practices, or terms of third-party services. Your use of such services is at your own risk.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We do not verify the accuracy of property listings, agent credentials, or landlord representations. Users should conduct their own due diligence before making real estate decisions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENHOUSECANADA INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 CAD, whichever is greater.

You agree to indemnify and hold harmless OpenHouseCanada Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.

We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.
